Terms of Service
1. Who we are and what these terms cover
Gatherly ("Gatherly", "we", "us") operates this website and its related services: event listings, the discovery feed, engagement reports, and paid plans (together, the "Service"). By creating an account or using the Service you agree to these terms. If you are under 18, you confirm a parent or guardian has reviewed these terms with you. Gatherly is operated from New South Wales, Australia, and these terms are governed by NSW law.
2. Relationship to other platforms
Gatherly is an independent service. We are not affiliated with, endorsed by, or sponsored by Police Roleplay Community (PRC), Emergency Response: Liberty County (ER:LC), Roblox Corporation, Discord Inc., or Stripe Inc. You remain bound by each platform's own terms when you use it, including the Roblox Terms of Use and Community Standards, the Discord Terms of Service, and the PRC API terms. We may suspend features where required to stay compliant with those platforms.
3. Your account
- You sign in with Discord. You are responsible for activity on your account and for keeping your Discord account secure.
- One person per account. Do not sell, share, or transfer accounts.
- We may suspend or terminate accounts that breach these terms, abuse the Service, or create risk for other users, with notice where practicable.
4. Event listings and acceptable use
- You are responsible for the content of your listings, including titles, descriptions, banners, and join codes. Listings must be for genuine ER:LC events you actually intend to host.
- Listings run for a maximum of 90 minutes and are removed from the discovery feed automatically at their end time.
- You must not post content that is misleading, infringes intellectual property, sexualises minors, harasses anyone, breaches Roblox or Discord rules, or is otherwise unlawful. We may remove any listing or banner at our discretion.
- You must not scrape the Service, probe or attack our infrastructure, bypass rate limits, or attempt to access other users' data or staff functions.
5. ER:LC API keys and reports
- You may connect an ER:LC server API key only for servers you own or are authorised to administer.
- We use your key solely to read server statistics for your event windows. We never issue commands to your server.
- Reports are compiled from data the PRC API makes available and are provided "as is" for informational purposes. PRC may change or limit its API at any time, which can affect report accuracy or availability; that is outside our control.
- AI-generated summaries are automated interpretations of your report data and may contain errors. They are not professional advice.
6. Paid plans, billing, and refunds
- Paid plans renew weekly. Card payments are processed by Stripe on Stripe's hosted checkout; we never see or store your card details. Robux payments work by verified gamepass ownership through the official Roblox API and are subject to Roblox's own payment terms, which we do not control.
- You can cancel at any time. Your plan stays active until the end of the period already paid for, and no further charges are made.
- Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If the Service has a major failure you are entitled to a refund or to cancel and be refunded for the unused portion; for other failures you are entitled to have the problem fixed in a reasonable time. Nothing in these terms limits those rights. We do not offer change-of-mind refunds beyond what the law requires.
- Boost credits and plan features have no cash value and expire when your plan lapses.
7. Intellectual property
You keep ownership of content you upload (such as banners) and grant us a worldwide, non-exclusive licence to host, display, and distribute it for the purpose of operating the Service. The Gatherly name, logo, design, and software are our property. ER:LC, Roblox, and Discord names and marks belong to their respective owners.
8. Service availability and changes
We aim for high availability but the Service is provided "as is" and may be interrupted, including by outages at Netlify, Discord, Roblox, PRC, or Stripe. We may change or discontinue features with reasonable notice where the change materially reduces a paid plan's value, in which case you may cancel and receive a pro-rata refund of the unused period.
9. Liability
To the extent permitted by law, and without limiting your rights under the Australian Consumer Law, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose, or AUD $50 if you have paid nothing.
10. Contact and disputes
Questions or complaints: use the support form. We aim to resolve complaints within 14 days. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.
Privacy Policy
1. Overview
This policy explains what we collect, why, and your choices, consistent with the Australian Privacy Principles in the Privacy Act 1988 (Cth). The short version: we collect the minimum needed to run listings, reports, and billing, we never sell your data, and you can delete everything yourself from Settings.
2. What we collect
- Account data: your Discord user ID, username, and avatar, received when you sign in with Discord OAuth. We do not receive your email address or password.
- ER:LC API key: stored encrypted with AES-256-GCM. It is decrypted only at the moment a report or connection test runs, and you can remove it at any time in Settings.
- Event and report data: your listings and the statistics compiled into reports (joins, sessions, staff activity, mod calls) as exposed by the PRC API for your server.
- Delivery settings: a Discord webhook URL if you save one, your bot-DM opt-in choice, and any extra report recipient Discord ID you attach to an event.
- Payment data: handled entirely by Stripe (card) or Roblox (Robux). We store only your plan, its verification timestamp, and, for Robux verification, the Roblox user ID you supply. We never receive card numbers.
- Technical data: coarse rate-limit counters keyed to IP addresses to prevent abuse, and a staff audit log of administrative actions.
3. How we use it
To operate listings and the discovery feed, compile and deliver your reports, process subscriptions, prevent abuse, and provide support. If AI summaries are enabled, your report's statistics (not your API key) are sent to Anthropic's API to generate the summary text.
4. Who we share it with
- Service providers: Netlify (hosting and storage), Discord (login and report delivery), Stripe (card payments), Roblox (gamepass verification), PRC (your server's API), and Anthropic (AI summaries). Each receives only what its function requires, and some are located outside Australia (primarily the United States).
- Other users: your listings, host username, and banner are public by design. Your reports are private to you and any extra recipient you choose.
- We do not sell personal information, and we disclose it to authorities only where the law requires.
5. Security
Sessions are signed cookies marked HttpOnly, Secure, and SameSite. ER:LC keys are encrypted at rest. Admin actions require server-verified staff roles and are audit-logged. No system is perfectly secure, so if we become aware of a data breach likely to result in serious harm we will notify affected users and the OAIC as required by the Notifiable Data Breaches scheme.
6. Retention and deletion
Data is kept while your account is active. "Delete account" in Settings immediately and permanently removes your account record, encrypted key, and all your events and reports. Coarse rate-limit counters and audit entries naming staff actions may persist for security purposes for up to 12 months.
7. Your rights
You can access and correct your information from Settings, or contact us via the support form to request access, correction, or deletion, or to complain about our handling of your information.
8. Children
The Service is designed around games rated for teens. We do not knowingly collect more information from under-18 users than the Service requires, and parents or guardians can use the support form to request deletion of a minor's account.
9. Changes
We will post any changes to this page and update the date above. Material changes to how we handle personal information will be announced on the site before they take effect.
Should these documents change, to the best of our ability we will notify all customers and patrons affiliated with our services.
